Sean Combs has one less thing to worry about.

For Diddy, his life right now requires a lot of patience and waiting. His trial for major charges is scheduled to begin in May of next year, but he recently got into a bit of a pickle as he continues to hold out hope for bail. He has essentially been “rotting” in jail since his arrest, but he’s been hopeful that a bail hearing could see him go free at least for a little bit of time.

That hope came crashing down last week, when prosecutors filed an opposition in which the federal government claimed that Sean Combs had violated regulations put in place by the jail. They alleged Diddy had essentially been plotting from the inside, making illegalcalls,s and other misdeeds. Those claims nearly saw Diddy’s chance at freedom go up in smoke, but that may have changed now.

On Tuesday, Diddy got a “win,” although it has nothing to do with anything he did. A federal judge refused to consider evidence that was obtained during a sweep of Diddy’s jail cell.

Combs’ attorney, Marc Agnifilo, called the initial move “outrageous government conduct,” and it appears the judge agreed.

“When we visit him in jail, we have lists. Everything in these pads are things we discuss. Trial strategy: who we should speak to to undermine a witness’ credibility. We discuss everything with Mr. Combs… Once they got [the photos of the documents], the first thing they did was use them, specifically use them by putting them in a bail letter to keep Combs in jail.”

Agnifilo called the jail cell raid a “due process violation.” The evidence is now unused in court for his next bail hearing.

Combs will have that third bail hearing scheduled for this Friday. Whether this “win” will end up in a win in court remains to be seen. But it can only help his case.
